NGBOA Sunset Project

Purpose:  End the Northgate Business Owners Association (NGBOA) according to the sunset clause in Section 10.1 of the Declarations:


"...this Declaration shall be effective for 30 years after the date that this Declaration was originally recorded (8 July 1997), and, thereafter, shall be automatically extended for successive periods of 10 years unless, prior to the end of the initial 30-year term or any subsequent extension thereof, a document signed by the Owners of at least 67 percent of the total number of Lots, stating that extension is not desired, is recorded in the real property records of El Paso County, Colorado."


Reasons: 1. Declarations Section 1.3 deny Owners participation in NGBOA governance (taxation without representation), 2. Section 4.4(d) allows NGBOA to charge upwards of $300 annually without Owners consent, 3) Section 4.8 allows NGBOA to place and foreclose a lien on properties that fail to pay assessments, and 4) the burden of maintaining the Voyager greenway is not equally shared as Flying Horse and The Farm are exempt from NGBOA assessments even though they benefit the same as those who pay.


Program: Circulate a petition among 2,062 Owners and obtain 1,382 signatures (67%) indicating an extension of Declarations is not desired ending the NGBOA and any further legal or financial obligations on the part of Owners effective July 7th, 2027. 


Scope (estimated): Deer Creek, Estates at Middle Creek, Greyhawk, Middle Creek Manor, Morning View, Northgate Highlands, Promontory at Northgate, South Valley at Trail Ridge, Serenity Park, Stone Crossing, Stonewater, Trail Ridge, Trail Ridge South, Villas at Northgate, Wildwood, Wildwood Ridge

Status Summary: Volunteers actively canvassing Deer Creek. Contacts made and petitions sent to Promontory, South Valley, Serenity Park, and Trail Ridge South. Will begin canvassing other neighborhoods once weather improves. Meanwhile, always grateful for new volunteers.
